For a while now, Nintendo Switch users have been complaining about faulty Joy-Con controllers. Many consumers claim to have experienced the “Joy-Con drift” issue. Drifting causes the analog sticks to freely move around and register inputs automatically, without the player touching it. Eventually, they grew frustrated over this, and it soon became a major issue.
Last year in July, a class-action lawsuit was filed against Nintendo on the grounds of non-disclosure of faulty Joy-Cons. The video game company didn’t acknowledge the alleged defects with the Switch controllers. However, they reportedly ceased to charge for repairing the faulty controllers. Also, they started refunding customers who had already paid for a fix.
During an investor meeting in June this year, Nintendo President Shuntaro Furukawa issued a public apology regarding the drifting Joy-Cons. He added the company was aiming at improving their products. However, since the Joy-Con was the subject of a class-action lawsuit, he refrained from mentioning any specific actions taken by the company.

Prosecuting law firm requesting short videos of Joy-Con drift experience from Nintendo Switch users
According to a VGC report, Nintendo claims that the Joy-Con drift issue “isn’t a real problem or hasn’t caused anyone inconvenience”. Chimicles Schwartz Kriner & Donaldson-Smith LLP (CSK&D), the US law firm that filed the class-action lawsuit against Nintendo, gave the statement.
The complaint was filed in the United States District Court for the Western District of Washington. It alleges that the joysticks on Switch controllers are defective, causing users to experience drift issues. In March, the court approved Nintendo’s move to compel the case to arbitration, while declining to dismiss the case.

CSK&D is currently pursuing the case through the arbitration process. As reported by VGC, the law firm is now responding to Switch consumers who had contacted it regarding the Joy-Con drift.
The LLP entity is asking the users to submit short videos describing their experience with the drifting controllers. It will aid the law firm to demonstrate the issues and their impact, towards its prosecution of the case. u/mittenscone posted an email from the law firm on Reddit.
“We are working on putting together a montage of video clips from Nintendo Switch owners such as yourself as a way to give voice to the joy-con drift issues you’ve experienced. This will be helpful to us in responding to Nintendo’s arguments about how this isn’t a real problem or hasn’t caused anyone any inconvenience.”
CSK&D will put together a montage of video clips from Switch owners and intends to share it with Nintendo’s attorneys and the company’s representatives. The law firm has requested concerned users to email them the videos by October 16.
